1. Statutory right of withdrawal

The following provisions apply to consumers. A consumer is any natural person who enters into a contract for purposes which are predominantly neither commercial nor related to their self-employed professional activity.

Consumers have the right to withdraw from a contract concluded via the Fulvicherb online shop within fourteen days without giving any reason.

1.1 Start of the withdrawal period

The withdrawal period is fourteen days from the day,

at which you, or a third party designated by you who is not the carrier, received the goods;
in the case of a single order for several items which are delivered separately, on the date on which you or the third party designated by you received the last item;
in the case of goods delivered in several instalments or items, on the date on which you or the third party designated by you received the final instalment or item;
in the case of contracts for the regular supply of goods over a specified period, on the date on which you or the third party nominated by you received the first goods.

You may also withdraw from the contract at any time between the conclusion of the contract and receipt of the goods.

1.2 Exercising the right of withdrawal

To exercise your right of withdrawal, you must inform us of your decision to withdraw from the contract by means of a clear statement. The statement may be sent, in particular, by post or by email:

Cancel the contract

You can use the cancellation function to submit your name, the details required to identify the order and your email address. Before finally submitting the form, you can check your details and submit the cancellation by clicking the „Confirm cancellation“ button.

Once you have submitted your withdrawal notice electronically, you will immediately receive a confirmation of receipt by email. This confirmation will include the content of your withdrawal notice, as well as the date and time of its receipt.

To ensure that the cancellation period is observed, it is sufficient for you to send your notice of cancellation before the end of the fourteen-day cancellation period.

2. Consequences of withdrawal

If you withdraw from the contract, we will refund all payments we have received from you. This includes the cost of the cheapest standard delivery option we offer.

Any additional costs incurred as a result of you choosing a delivery option other than the cheapest standard delivery option we offer will not be refunded.

The refund will be made without delay and no later than fourteen days from the date on which we receive your notice of withdrawal.

We will generally use the same payment method for the refund as you used for the original transaction. A different refund method will only be used if this has been expressly agreed with you. You will not incur any additional charges as a result of the refund.

We may withhold the refund until we have received the returned goods or until you have provided proof that you have posted the goods. The earlier of the two events shall apply.

3. Returning goods

Once you have given notice of withdrawal, you must dispatch or hand over the goods without delay and at the latest within fourteen days to one of the return addresses listed below.

The return period is deemed to have been met if you post the goods before the end of the fourteen-day period.

You are not required to contact us before returning the goods in order to exercise your statutory right of withdrawal. However, notifying us in advance may make it easier to identify and process your return.

Please ensure the goods are securely packed for transport. There is no requirement to use a specific type of packaging or the original shipping packaging in order to exercise your right of withdrawal.

4. Returns via Packeta

For returns from Germany and Austria, you can use the Packeta collection points listed above.

When returning the item, please clearly state the Fulvicherb Webshop ID 95154617 and, if possible, please also provide your order number so that the parcel can be linked to your order.

When dropping off your parcel, please give the Fulvicherb webshop ID to the staff member at the collection point 95154617 with.

If you would like us to help organise the return, please contact us at info@fulvicherb.de. You will be informed of the costs involved in the return transport organised by us before you place your order.

5. Return postage costs

You are responsible for the direct costs of returning the goods, unless we have expressly agreed to cover these costs.

If, at your request, the return is organised by us or by a service provider we have appointed, you will be informed of the associated costs before the return is arranged.

Returns sent carriage forward or on a cash-on-delivery basis do not have to be accepted if this results in additional costs. Your statutory consumer rights remain unaffected.

6. Depreciation of the goods

You are only liable for any loss in value of the goods if this loss is attributable to handling of the goods that was not necessary for the purpose of ascertaining their nature, characteristics and functioning.

7. Exclusion or premature expiry of the right of withdrawal

In particular, the right of withdrawal does not apply to contracts for the supply of

Goods which are not prefabricated and the manufacture of which is determined by the consumer’s individual choice or specifications;
Goods that are clearly tailored to the consumer’s personal needs;
Goods that are likely to spoil quickly or whose use-by date would be exceeded quickly.

In the case of sealed goods which, for reasons of health protection or hygiene, are not suitable for return, the right of withdrawal expires prematurely if the seal has been broken after delivery.

This may apply in particular to opened food supplements or foodstuffs where a seal fitted to protect the contents has been removed and the goods are no longer suitable for return on grounds of health or hygiene.

Simply opening the outer shipping packaging does not result in the right of withdrawal being forfeited.

8. Damaged or faulty goods

The above provisions regarding the right of withdrawal apply irrespective of your statutory rights in the event of defective or damaged goods.

The costs of a valid return due to a fault are governed by the statutory provisions. Your statutory warranty rights are not affected by a failure to contact us in advance.
